Harish Salve demolishes Opposition argument on 'state autonomy' vis-a-vis One Nation,One Election ::: Waxes eloquently - “There is no constitutional guarantee that once you're elected, you will run for five years"

Legal luminary Harish Salve pooh poohed Opposition argument on the so-called 'autonomy' debate for the states vis-a-vis One Nation, One Election (ONOE) and said:


“There is no constitutional guarantee that once you're elected, you will run for five years, come what may. If there is no such constitutional guarantee, the fundamental assumption is wrong.

"Our Constitution has never been considered immutable. Article 368 has a provision to amend the Constitution. A 54-year-old leader, who calls himself 'yuva' (youth), keeps roaming around with the Constitution, claiming that we would change it. 
I want to say that the provision to amend the Constitution is built in," Amit Shah said in Rajya Sabha.

 




"You have to disrupt the system once to get it together for the rest of the life of the Constitution," eminent lawyer commented.  


“The state assembly has no indefensible right to continue for five years,” he asserted.

Acknowledging the challenges of implementing ONOE, Salve emphasised the need for a structured roadmap, potentially taking three to five years. 


“This cannot be rushed through,” he assured, adding that the Election Commission would require time to prepare for the logistical demands, including ensuring sufficient Electronic Voting Machines (EVMs).  



He urged critics to engage constructively with the proposal: 

“Please read the report carefully. Maybe you have some excellent objections. Articulate them. Let it be debated in different public forums.” 


Salve also stressed the importance of building a broad consensus involving political parties, stakeholders, and the public.   


Harish Salve, who was also a member of the Ram Nath Kovind-led Committee on ONOE, emphasised the need for a detailed and informed discussion about the proposal.
