Delhi High Court finds Wangchuk not under detention, declines interim relief to shift him to private hospital

The Delhi High Court rejected the claim that Wangchuk was being detained or that his bodily autonomy was being violated.  

The order came on a plea filed by Wangchuk's wife, Gitanjali Angmo, who sought his transfer from Safdarjung Hospital to Medanta, arguing that he should be allowed to receive treatment at a medical facility of his choice.

He remains a free citizen and doctors at the hospital have treated him only with his consent.  

Delhi High Court has backed the government's decision to shift climate activist Sonam Wangchuk to Safdarjung Hospital.

The High Court issued notice to the government, police and hospital authorities and directed them to file a status report within three days. 

The matter will next be heard on Thursday. No interim order was passed at this stage.

The court heard arguments from both sides, as well as doctors from Safdarjung Hospital and the emergency medicine department of AIIMS.  

The court took note of the fact that Wangchuk had been on hunger strike for around 17-18 days and that a Division Bench had passed an order on July 16 after considering his perilous medical condition.

TMC says the strength of All India Trinamool Congress in the list provided by table office is shown to be 28 members and these 'so-called rebel 20 MPs' merger has not been approved by Speaker.  

The entire opposition on Sunday staged a symbolic walk out from the all-party meeting convened here ahead of Parliament's Monsoon Session to protest against the invitation extended to rebel TMC MPs.

The opposition also protested against Lok Sabha Speaker Om Birla's decisions on the rebel TMC lawmakers, allowing them separate seats in the House and merger of the rebel Shiv Sena (UBT) MPs with the Shiv Sena led by Maharashtra Deputy Chief Minister Eknath Shinde.
