The Uniform Civil Code, implemented by Uttarakhand, aims to simplify and standardize personal laws related to marriage, divorce, succession, and inheritance.
Under this, marriage can be solemnised only between those parties, none of whom has a living spouse, both are mentally capable of giving legal permission, the man should have completed at least 21 years of age and the woman 18 years of age and they should not be in the ambit of prohibited relationships.
The UCC Act of Uttarakhand will govern and regulate the laws relating to marriage and divorce, succession, live-in relationships and related matters.
It sets equal marriageable age for men and women, grounds of divorce and procedures across all religions, and bans polygamy and 'halala'.
Aimed at standardising personal laws across all religions, the UCC has sparked both support and opposition since its inception.
During the 2022 Uttarakhand Assembly elections, Chief Minister Pushkar Singh Dhami had pledged to implement the Uniform Civil Code (UCC) if BJP was re-elected to power.
Following his victory, he formed a five-member committee led by Justice Ranjana Prakash Desai to draft the code, which incorporated feedback from over 2.3 lakh citizens.
UCC is a set of laws that aims to standardise personal laws across religions. The move has sparked both support and criticism, with proponents arguing for equality and opponents warning of potential societal divisions.
It addresses various societal issues, including marriage, divorce, inheritance, and live-in relationships.
Key aspects of the law include the registration of marriages, divorces, and live-in relationships.
In Uttarakhand, the act applies to the entire state and is also effective on the residents of the state living outside Uttarakhand.
Scheduled Tribes and protected authority-empowered persons and communities are exempted from the parameters of UCC.
HOW TO USE ONLINE PORTAL?
The online portal launched at around 12:30 pm today (Jan 27th) and will be available for use by the citizens of Uttarakhand starting next week.
It will allow residents to register marriages, divorces, succession rights, live-in relationships, and their termination.
The 740-page draft was presented to the Chief Minister on February 2, 2024, and was approved by the cabinet on February 4.
The UCC is set to be implemented in Uttarakhand on January 27, coinciding with Prime Minister Narendra Modi’s scheduled visit to Dehradun.
The UCC is just an offering made by our state in the great 'yagya' being performed by the Prime Minister to make the country a developed, organised, harmonious and self-reliant nation," CM Dhami said.
