BJP issues whip to Lok Sabha members :  

House may debate motion to remove Speaker Om Birla 

All eyes also on Substantive Motion moved against Rahul Gandhi by BJP's vocal lawmaker Nishikant Dubey  


"All members of the BJP in Lok Sabha are therefore requested to be positively present in the House on both the days and support the government's stand," the BJP directive said.

In Feb 2026, the opposition submitted a no-confidence notice seeking the removal of Lok Sabha Speaker Om Birla, accusing him of acting in a partisan manner. 

As Parliament reconvenes on Monday, the notice is expected to be taken up for debate.  


The ruling BJP has issued a whip to all its Lok Sabha MPs asking them to remain present in Parliament during proceedings on March 9 and 10.

It is being presumed that the notice seeking the removal of Speaker Om Birla could come up for discussion first. 


The directive mentioned that some very "important legislative business" would be taken up.  


The BJP sources say it is a "routine parliamentary directive". 


Such whips are routinely issued by all parties (or at least the most) to ensure that all their members are present in Parliament during key discussions, voting the passage of important bills. 


Om Birla, who represents Kota parliamentary seat in Rajasthan, Last month is already not presiding House proceedings since the notice was issued.


The opposition parties led by Congress submitted a no-confidence notice seeking the removal of the Lok Sabha Speaker.


It was signed by 118 MPs. The notice is likely to be taken up for discussion on Monday, March 9th itself.







Birla is unlikely to chair the Lok Sabha proceedings until the motion against him is discussed and disposed off.

In a rare moment, Birla will be seated among the MPs in the House.


Of course, the rules say the Speaker will have the opportunity to defend himself when the notice is discussed.  









"We had given specific instances of partisan behaviour (by the Speaker), while false allegations were levelled against the opposition members," Congress member in Rajya Sabha, Jairam Ramesh, said.  


Last month during the session, Lok Sabha Speaker Om Birla had schooled LoP Rahul Gandhi for not following proper Parliamentary procedure during a debate on the motion of thanks to the President's address in the Lok Sabha.


After Rahul Gandhi gave "permission" to another MP to speak while he was speaking, the Speaker said, "Who are you to give this permission? You can't give permission, that's my right".

"You have no right to allow anyone, only the chair has the right to allow."


Om Birla chided Mr Gandhi after the Congress leader, while delivering his remarks, paused and indicated to BJP MP Kamlesh Paswan who was on his feet and wanted to say something. "I am a democratic person and I will allow the other person to speak," Mr Gandhi had said earning a sharp rebuke from the Speaker. 


The Congress leader during the motion of thanks on the President's address, was seen taking a dig at Prime Minister Narendra Modi by saying, "'India cannot be ruled as a kingdom...The King does not listen to anybody."








The second part of Budget session will also a curious debate and turns and twists on a Motion moved against Rahul Gandhi. 


In his substantive motion notice, Nishikant Dubey of BJP has sought cancellation of Rahul Gandhi's Lok Sabha membership and a ban on him contesting elections for life.  


In his notice, Dubey said he mentioned that Rahul Gandhi visits foreign nations such as Thailand, Cambodia and Vietnam, joining hands with the Soros Foundation, Usaid and Ford Foundation, and "colludes" with anti-India forces. 


The Lok Sabha Speaker may be consulted on whether to send Dubey's substantive motion to the House privilege panel, the ethics committee or place it directly before the Lower House.


In the past, several parliamentarians have faced such motions, as recently as Trinamool Congress MP Mahua Moitra. 

She was expelled by a House vote on such a motion in the cash-for-query scam in 2023.


However, Ms Moitra returned to the House by winning the 2024 Lok Sabha election from the same seat in West Bengal's Krishnanagar segment. 


If the Substantive motion is admitted and subsequently passed by the House, the Lok Sabha Speaker may constitute a committee to investigate the allegations. 


The committee would be given a defined timeframe to submit its report. Once submitted and tabled in the Lok Sabha, a further motion may be moved for the House to consider and decide on accepting the committee's recommendations.


The Lok Sabha has the power to expel its members for serious misconduct or actions that damage the Parliament's dignity.







Removal of judge over money scandal

In 2009, 57 members of the Rajya Sabha gave notice of a motion for removal of Justice Soumitra Sen of the Calcutta High Court for misappropriation of money. 

An inquiry committee was constituted to look into the charges and found him guilty. The motion for impeachment of Justice Sen was taken up by the Rajya Sabha on August 17, 2011. 


The Upper House adopted the motion for presentation to the President for his impeachment by a special majority, and this was then referred to the Lok Sabha. 

However, he resigned on September 2, 2011, before the Lok Sabha could take up the matter.
