Is a judge competent to decide that ??? - No less than Indira Gandhi had said so ..... ::: BJP throws a reminder -- "The Congress must know its past"

 BJP IT cell chief Amit Shah tweeted a video on Monday wherein former Prime Minister Indira Gandhi had said -- 


"How does Mr Shah (then a judge) know what is happening in the political world? Which are the forces that work which want to destroy a developing economy? 


Is a judge competent to decide that? Then why have elections, why have political people in power?" 










The message from Amit Malviya has a political significance as a number of BJP leaders have lately gone vocal and have been critical of the Supreme Court saying no one could issue directives or set a deadline for the President.  


Earlier this month, the Supreme Court invoked extraordinary powers under Article 142 to pass 10 Tamil Nadu bills that were hanging fire with the Governor R N Ravi for several months. 


It also directed, for the first time, that the President should decide on bills referred by governors within three months.








"How can you give direction to the appointing authority. Chief Justice of India is appointed by President of India... Law in India is made by India's parliament; you are dictating terms to that Parliament," said BJP MP Nishikant Dubey.


"Close down Parliament if…", the BJP lawmaker said.



"Kanoon yadi Supreme Court hi banayega to Sansad Bhavan bandh kar dena chahiye, (If law is to be framed by Supreme Court; then we should close down Parliament of India)," Nishikant Dubey said in post in on X.  

Another BJP leader Dinesh Sharma, former deputy chief minister of Uttar Pradesh, was also critical of the top court.



In West Bengal, the Lotus party legislator Agnimitra Paul backed party Nishikant Dubey's remarks. 


"The CJI is appointed by President of India ... so how can CJI ignore or show disrespect to the office of the President".   



Meanwhile, in an interesting twist, the Supreme Court on Monday (April 21) made a passing remark on allegations of judicial overreach by a section of BJP leaders while hearing a petition seeking President's rule in violence-hit West Bengal.  



A bench of Justices B R Gavai and Augustine George Masih said, "You want us to issue a writ of mandamus to the President to impose this? As it is, we are facing allegations of encroaching into the executive (domain)."  



Vice President Jagdeep Dhankhar also has accused the top court of overstepping its remit and stressed that the Supreme Court was acting like the "super parliament".
