"Nothing was seized by the ED. Everything was taken away by Mamata Banerjee and her cohorts" - ED tells Calcutta High Court

 "Nothing was seized by the ED. Everything was taken away by Mamata Banerjee and her cohorts." - said Additional Solicitor General Suryaprakash V Raju.  


The Calcutta High Court recorded ED’s statement that nothing was seized during the IPAC searches conducted on 8 January, after TMC’s lawyer submitted that the plea could be disposed of upon such recording. 

TMC clarified it was seeking only one relief—protection of its data, if any had been seized. In view of the statement, the Court disposed of TMC’s plea and adjourned ED’s separate plea at the agency’s request, noting that related issues are pending before the Supreme Court.


The High Court disposed of Trinamool Congress’s application while adjourning ED’s plea. The Additional Solicitor General objected to Mamata Banerjee’s counsel arguing, stating the TMC was not even a party in the ED’s case.


ASG: If there is no data seized how can I maintain it? Therefore the petition (by Trinamool Congress) is vague and not maintainable.


"ED has not taken anything. Mamata Banerjee took away the data…we don’t have possession of anything. My statement may be recorded ... She physically took all records and documents. 

She and the DGP should be made party," Raju said.






Search has nothing to do with Trinamool Congress. The person [whose premise searched] has not approached Court: ASG Raju  

I am showing he [TMC representative] has filed false affidavit, he said. 


"The person who signed the affidavit is an authorised signatory of the petitioner. How does he become well acquainted with facts? Was he present there? He was not present there and I can prove it. The address whose premises were involved has not come to court," ASG Raju, appearing for the ED, told the Calcutta High Court.  


"The entire petition is based on arguments regarding election and not infringement of any right. Someone's data has been seized from someone's house, they should come to court. I-PAC should have come here," ASG Raju said.  


ASG Raju cites TASMAC case which is pending before Supreme Court, regarding ED's power to search and seize documents.


The record if any seized was by Mamata Banerjee. She has taken possession illegally and committed offence. Unless she is made party by TMC, plea is not maintainable. No records seized by ED: ASG Raju


"The petition is filed by a stranger. Kindly look at who the petitioner is. How does he become acquainted. He was not there at search. Petitioner is All India Trinamool Congress, he is authorized signatory. Where is the authority?"
