As directed by the Supreme Court, the Director General of Police Manipur, Rajiv Singh, is present in the apex court today for hearing on Manipur violence.
#SupremeCourt appoints special panel on #Manipur violence ... headed by Justice Gita Mittal (former Chief Justice of J&K High Court), and will consist of Justice Shalini Phansalkar Joshi ( former Bombay HC judge) and Justice Asha Menon(former Delhi HC judge).
The Supreme Court on Monday said that it will pass a slew of directions in relation to the Manipur violence cases to "restore a sense of faith in the rule of law and build a sense of confidence".
As regards investigation, the Court noted that the Centre has decided to entrust 11 FIRs relating to sexual violence to the Central Bureau of Investigation.
The Court said that it will allow the transfer of these cases to the CBI. However, it will also include 5 officers from the rank of at least Dy SP if not SP drawn from other States "to ensure that there is a sense of faith and an overall feeling of objectivity".
The Court clarified that these officers will be functioning within the administrative set up of the CBI.
Solicitor General Tushar Mehta says, "In the CBI team- which will be investigating this - that has two lady SP officers.
CBI has officers from all across the country. We have taken that balance."
Attorney General R. Venkataramani says, "....on the basis of analysis of FIRs and nature of offences, we have made this district configuration. In case of murders, there will be SPs etc, then in sexual offences there will be teams fully comprising of female investigative officers..."
Chief Justice D Y Chandrachud asks SG Mehta, "Last time you said that CBI will be investigating 11 cases. Has that number been altered?"
Attorney General R Venkataramani says: In terms of the SC order: regarding disaggregation of offences. As on today we have to be careful. The govt is handling this at a very mature level.
The AG further said, "....there will be 6 SITs in each district where there was violence..."
"In case of murders: it will be investigated by SP and other senior officers. for sexual offences there will be woman officers. For other offences it will be DySP etc.."
Mr Venkataramani also said, "Peace must be unconditional.. any process to weaken it must be avoided".
The Supreme Court said that the committee of three former female High Court judges will "look at diverse aspects on humanitarian nature". It will also examine matters related to relief, remedial measures, rehabilitaiton measures, restoration of homes and places of worship.
The Supreme Court also said that it will add "one more layer of security" by appointing one officer to oversee the CBI investigation, who will be reporting to the apex court itself.
Former Maharashtra DGP and Mumbai Police Commissioner, Dattatray Padsalgikar has been given that by the Court as the 'overseeing officer'.
