Places of Worship Act violates equality, must be abolished: BJP MP Harnath Singh Yadav in Rajya Sabha


The MP argued in Rajya Sabha that the 1991 Act perpetuates discrimination between Lord Rama and Lord Krishna, both being incarnations of Lord Vishnu, and is unconstitutional and illogical.  

Harnath Singh Yadav flagged off the controversial law enacted during the P V Narasimha Rao regime1991.


During Zero Hour, he said on Monday, Feb 5, that the law be abolished.

Singh argued that the 1991 Act creates distinctions between gods like Lord Rama and Lord Krishna, both considered incarnations of Lord Vishnu, and undermines the religious rights of Hindus, Jains, Sikhs, and Buddhists.


“The 1991 Act violates the constitutional principle of equality and sees cases related to places of worship, barring the Ayodhya matter, dating back to 1947 as resolved. Those found guilty of violating this law face imprisonment ranging from one to three years. 

The Worship Places Act 1991 imposes restrictions on the religious rights of followers of Hindu, Sikh, Jain, and Buddhist faiths."



Gyanvapi: 'protected' by the Act 



"I commend the Prime Minister for acknowledging that those who held power for an extended period after Independence failed to understand the significance of our religious sites and shamelessly exploited our own culture for political gains,” Harnath said addressing the Rajya Sabha. 


In 2019, after the Supreme Court’s Ram Janmabhoomi verdict, when RSS chief Mohan Bhagwat was asked whether the Sangh would also take up the similar temple-mosque controversies in Varanasi (Gyanvapi mosque) and Mathura (Shahi Idgah), he said - No. 


But it is altogether a different matter that following the inauguration of Ram temple a Ayodhya last month, demands for a re-look at the Places of Worship Act, 1991 have grown.

The Act in effect seals the character of places of worship as they stood on 15 August 1947.

Prime Minister Modi said it is the Congress that is responsible for the state of the Opposition


"The Congress never trusted India's potential. They always considered themselves rulers and belittled people," the Prime Minister said during the discussion on the Motion of Thanks to President Droupadi Murmu's address. 


Quoting a speech by Nehru from Red Fort, he said, "Nehru had said, 'We do not work as hard the Europeans, Japanese, Chinese, Russians or the Americans. Do not think that these communities became prosperous by some magic. They have achieved this by hard work, by smartness.' This shows Nehru thought Indians were lazy and did not have brains. He did not trust their potential," the Prime Minister said.








Former Prime Minister Indira Gandhi did not think differently either, he said. "Indira ji had said from (the ramparts of) Red Fort, 'Unfortunately, it is our habit that when a good work is approaching completion, we become complacent. And when an obstacle comes, we lose hope. Sometimes it seems the whole nation has accepted defeat'. Looking at Congress today, it appears that Indira ji may have underestimated the countrymen, but she evaluated the Congress well," he said.

"This was the thinking of the Royal Family of Congress about Indians," the Prime Minister said, adding that he has immense faith in the ability of the country and its people.

The Prime Minister quoted Jawaharlal Nehru's writings to bolster his claim that "history proves that Congress governments bring inflation". "Whenever Congress came (to power), it strengthened inflation. Our government has controlled it despite two wars and a pandemic," he said. 







Congress president Mallikarjun Kharge, he said, had shifted from Lok Sabha to Rajya Sabha. "Ghulam Nabi Azad shifted from the party altogether because of Parivarvaad. Efforts to launch the same product again and again are shutting down the Congress's dukaan," he said.










PM told the Opposition that "dukaan" is their word, not his. In his nationwide campaign accusing the BJP of spreading hate, Congress leader Rahul Gandhi has repeatedly said that he wants to open "Mohabbat ki dukaan" in a market of hate.

In another dig at Mr Gandhi, he said the Congress had recently learnt the work of an automobile mechanic -- an apparent reference to Rahul Gandhi's visit to a bike repair shop at Delhi's Karol Bagh. 


"The Congress has recently learnt the work of an auto mechanic, so they know what alignment is. But the alignment in the alliance has gone awry." PM said, referring to troubles within INDIA bloc months ahead of polls. 


Targeting the Congress and the Gandhi family, the Prime Minister said it is the Congress that is responsible for the state of the Opposition. "They failed and didn't allow other parties to perform either. They have ruined the parliament, the Opposition and the country. I believe the country needs a strong Opposition. The country has faced the ramifications of dynasty politics, and the Congress has faced it too," he said.
