In a significant judgement related to Gujarat 2002 riots, the Supreme Court on Saturday, Dec 17, dismissed a review petition filed by 'carnage survivor' Bilkis Bano seeking a review of its May 2022 order.
The apex court had ruled that the state government of Gujarat was/would be the appropriate authority to decide the prayer of one of the convicts for remission and that the state’s 1992 remission policy will apply in the case.
The Supreme Court dismissed Bano’s plea on December 13 and the decision was communicated to her counsel by way of a letter on December 16, sources said.
Bilkis Bano was allegedly gang-raped and her daughter was among 14 killed by a mob on March 3, 2002, in Limkheda taluka of Gujarat’s Dahod district, during the post-Godhra riots.
In May 2022, a bench comprising Justice Ajay Rastogi and Vikram Nath had ruled that the Gujarat Government had the jurisdiction to consider the remission request as the offence took place in the state of Gujarat.
The court also had directed the Gujarat government to decide the application as per the remission policy of 1992.
Ms Bilkis has also filed another writ petition challenging the decision of the Gujarat government to allow the premature release of the eleven convicts.
