SC orders CBI probe into Sushant death : Uddhav Govt & Mumbai police cornered


"While according approval for the ongoing CBI investigation, if any other case is registered on the death of the actor Sushant Singh Rajput and the surrounding circumstances of his unnatural death, the CBI is directed to investigate the new case as well. It is ordered accordingly," read the 35-page Supreme Court judgement.

Judgement by Justice Hrishikesh Roy said - "The actor Sushant Singh Rajput was a talented actor in the Mumbai film world and died well before his full potential could be realised. 

His family, friends and admirers are keenly waiting the outcome of the investigation so that all the speculations floating around can be put to rest. Therefore a fair, competent and impartial investigation is the need of the hour". 



"The expected outcome then would be, a measure of justice for the Complainant, who lost his only son. For the petitioner too, it will be the desired justice as she herself called for a CBI investigation".


-- "To ensure public confidence in the investigation and to do complete justice in the matter, this Court considers it appropriate to invoke the powers conferred by Article 142 of the Constitution".


"It is also the consistent view of the Court that it is not for the accused to choose the investigating agency," -- the court said exposing the questionable designs of Rhea Chakraborty 


"In the instant case, political interference against both states is alleged which has the potential of discrediting the investigation. The legal process must therefore be focused upon revelation of the correct facts through credible and legally acceptable investigation. It must be determined whether the unnatural death was the result of some criminal acts," the statement read.


The Maharashtra government lawyer asked for permission to challenge the verdict. However, the Judge said that it is now a court-ordered investigation.

The Mumbai Police will assist the CBI with their investigation. The Mumbai Police will handover all investigative material to the CBI.




..... "because both states are making acrimonious allegations of political interference against each other, the legitimacy of the investigation has come under a cloud. Accusing fingers are being pointed and people have taken the liberty to put out their own conjectures and theories. Such comments, responsible or otherwise, have led to speculative public discourse which have hogged media limelight. These developments unfortunately have the propensity to delay and misdirect the investigation". 

The Supreme Court said that the Bihar government's move to seek a CBI probe in the matter was competent. 

"Patna police committed no illegality in registering the Complaint. Looking at the nature of the allegations in the Complaint which also relate to misappropriation and breach of trust, the exercise of jurisdiction by the Bihar Police appears to be in order. At the stage of investigation, they were not required to transfer the FIR to Mumbai police," read the judgement.

"The ongoing investigation by the CBI is held to be lawful. In the event a new case is registered at Mumbai on the same issue, in the fitness of things, it would be appropriate if the latter case too gets investigated by the same agency, on the strength of this Court’s order. 

Such enabling order will make it possible for the CBI to investigate the new case, avoiding the rigors of Section 6 of the DSPE Act, requiring consent from the State of Maharashtra," the judgement read.





Late actor Sushant hailed from Patna and had come up the ladder through his relentless hard work and making use of the talent starting from a television serial.


CBI registered a case against Rhea Chakraborty and others after Sushant’s father K K Singh filed a complaint with the Patna police against her and her family members alleging abetment of suicide.

The Patna FIR had invoked IPC Sections 306 (abetment of suicide), 341 (wrongful restraint), 342 (wrongful confinement), 380 (theft in dwelling house), 406 (criminal breach of trust) 506 (criminal intimidation), 120B (criminal conspiracy) and 420 (cheating). The 34-year-old ill-fated actor was 'found hanging' from the ceiling of his apartment in Mumbai's Bandra on June 14.
Mumbai Police has been investigating the case.




This case and finally the Supreme Court order ending all speculation was also related to vigorous investigation by media. To an extent the role played by the television channels would also be debated in future as someways the fourth estate went into areas they were not expected. The TV channel owners and management had almost given free hand to the editors and news anchors.

To an extent, yes ! The case is political and perhaps more than the just fast approaching Bihar elections.

One school of thought suggests the manner this case has exploded, the future developments in the investigation and arrest of 'wrong doers' and those who tried to play 'saboteurs' will have direct impact in the politics of Maharashtra vis-a-vis the survival of the Uddhav Thackeray-led coalition dispensation.

BJP leader Dr Subramanian Swamy welcomed the verdict and said, "I am sure senior police officials will now spill the beans".

"Sushant Singh Rajput’s murder is Waterloo and Watergate for Bollywood, Mumbai Police and Maharashtra government. Fasten your seat belts as we are. about to take off and bombard & won’t give up till either guilty are brought to justice or justice is brought to the guilty," Dr Swamy had tweeted on August 16.


Speaking minutes after the verdict, actress Kangana Ranaut said the verdict is a victory of truth.

"We are now part of the history....I am so thrilled," she told Republic TV.


Throwing Uddhav Govt & Mumbai police into panic mode, SC orders CBI probe into Sushant's death

This is a massive blow to the Shiv Sena-led Maharashtra government and those who had opposed
an impartial CBI probe into the mysterious death of actor Sushant Singh Rajput.

Supreme Court on Wednesday, August 18 ordered the premier central agency to carry out the investigation.

Bihar DGP Gupteshwar Pandey and the counsel for Sushant Singh Rajput's family, Vikas Singh, have also welcomed the order of the apex court. 


The Sena government and leaders in the state including the likes of Sanjay Raut (Sena spokesman) and Majeed Memon (NCP) had opposed the intervention of Bihar police and others insisting that Mumbai police should be given time to investigate the case.


However, it is an altogether different chapter that for over 66-day, not even a FIR was filed by  Mumbai police.

The Supreme Court order had thrown Mumbai police and the Uddhav Thackeray government into a virtual panic mode.


There is already debate in TV and social media that Mumbai police commissioner Parambir Singh could be eased out from the high profile post.


Initially, Mumbai police had attributed the death of Sushant to suicide but later a series of media investigation and stings suggest there was foul play.



Sushant Singh Rajput's death was also linked to the 'suicide' of his former manager Disha Salian. The 34-year-old budding actor Sushant was found dead in his house on June 14 at Bandra West, Mumbai.


There has been a lot discussed and debated in the case and the Mumbai police role has also come under questioning.

Worst of all controversies was when the Mumbai civic body put Bihar IPS officer Vinay Tiwari under 'quarantine' when he had landed in Mumbai to pursue the probe.

"It is a very important day for Sushant Singh Rajput's family and his fans. The Supreme Court has accepted all our points," said Vikas Singh, counsel for the aging father of Sushant. 

The apex court order also held that what Maharashtra Police was doing was in a "limited scope".


Mumbai police commissioner Parambir Singh sounded defensive and said: "Once we get the order copy, we will examine it".
"We have spoken to our advocates in the Supreme Court ....and we will later decide further course of action," he said.


In most quarters this high profile case was also being linked to the fast approaching Bihar polls.

The Bihar government and state Chief Minister Nitish Kumar had only intervened into the case when the family of Sushant Singh Rajput found that the probe in Mumbai was not heading towards the desired direction and goal.

A new FIR was filed in a Patna police station and subsequently formal plea was made by the state government to the union Home Ministry seeking CBI probe.

Bihar politician and LJP leader Chirag Paswan also welcomed the verdict and said:

"Not only the truth will surface now but those names are also expected to come out who were 
possibly behind disrupting the genuine investigation in the case. I hope the Court's order has brought relief to Sushant Singh Rajput's family," said Chirag, son of Union Minister Ram Vilas Paswan. 


Shiv Sena spokesman Sanjay Raut defended the state government's role.

"Maharashtra is a state which always upholds the rule of law and justice. This has been Maharashtra's parampara (tradition). Only Mumbai Police Commissioner and Advocate General can comment on the legal matters. I should not
be making a political point now," Raut said.

Bihar CM & Union Home Minister

The central agency Enforcement Directorate has also started working in the case.

The controversial friend of Late Sushant, Rhea Chakraborty and her aides and brother have been questioned by the Enforcement Directorate.

ED is examining the charge of money laundering as a huge sum of money from Sushant's account has been allegedly siphoned off by Rhea and her family.
